Access to police pursuit rules for car chase crash

An Atlanta-area police officer was charged with reckless driving after allegedly failing to use his radar to watch a car chasing a suspect when it was allegedly involved in a fatal hit-and-run crash near Atlanta.

James M. Kratz was booked into the Fulton County Jail on suspicion of failure to stop for a traffic accident resulting in death Friday afternoon.

Police said a silver 2009 Honda Accord in the 600 block of East Broad Street in Fulton was hit by the 2009 Pontiac G6 on March 18, when a Pontiac G6 sped toward a passing vehicle in the intersection at Hightstown Avenue and Hightstown Way.

The driver of the Pontiac, identified as Thomas Parnell Jr., 32, of Atlanta, was taken to Georgia Medical Center after sustaining serious injuries.

At the time, officials said Kratz did not see or hear anything but was in his vehicle when the collision happened.

In a video obtained by WSB-TV, Kratz was allegedly seen behind the passenger side seat watching the car before turning his headlights to the G6 when he realized what was happening.

In the video, the passenger-side passenger of the sedan can be heard telling the officer: 'Sir, he got hit. Did you see where he was going? I tried to tell him I couldn't see his car.'

The officer tells the woman: 'We're gonna call 911 and ask for backup.'

However, Kratz does not respond to any of the officer's questions. He then swerves and hits Parnell, knocking him over and causing the car to flip over on its side. He then goes around the car, hitting Parnell, who lost control of the car and crash-landed.

The body of Thomas Parnell Jr. was discovered by emergency workers just before 7 p.m.

A Fulton County medical examiner has ruled Mr. Parnell Jr. died as a result of blunt trauma to his neck. The other person involved in the crash has not been identified, officials have said.

It was not immediately clear if Mr. Kratz had an attorney.
